THE SERVICES, INCLUDING ANY INSIGHTS, ANALYSES, OR RECOMMENDATIONS (AI- OR ML-GENERATED OR OTHERWISE), ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT INTENDED TO REPLACE THE PROFESSIONAL JUDGMENT OF A LICENSED HEALTHCARE PROVIDER. Acceptance of Terms
By accessing, browsing, or otherwise using preffect.com (the "Site") or our mobile applications (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not accept these terms, you will not access or use the Service.
Service Description
The Service is designed to enable users to track health and wellness data for purposes of providing users with insights, predictions, and recommendations.
Your Account
Registration
You may be required to register with Preffect to access certain features. If you choose to register, you agree to provide and maintain true, accurate, current, and complete information about yourself.
Age Requirements
- If you are under 13 years of age, you are not authorized to use the Service
- If you are under 18 years old, you may use the Service only with the express consent of your parent or guardian
Account Security
You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your account. You agree to immediately notify Preffect of any unauthorized use of your account.
User Conduct
You agree not to use the Service to:
- Upload content that infringes intellectual property rights or violates privacy
- Interfere with or disrupt the Service or servers
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Engage in data mining, scraping, or similar data gathering methods
- Circumvent geographic restrictions or content protections
Fees and Payment
To the extent the Service or any portion thereof is made available for any fee:
- You agree to pay Preffect the amount specified in your payment plan
- For subscription services, you authorize Preffect to bill your payment instrument periodically
- We reserve the right to change prices with at least 30 days' notice
- Payment processing is handled by third-party payment processors
Mobile Services
Mobile App License
Subject to these Terms, Preffect grants you a limited, revocable, non-exclusive, non-transferable license to install and use the Mobile App on one mobile device for your own personal use.
Data and Message Rates
Your wireless service carrier's standard charges, data rates, and other fees may apply when using Mobile Services. Preffect is not liable for any delays or failures in message delivery.
Intellectual Property
Service Content
The Service and its content are protected by copyright, patent, trademark, and other intellectual property laws. You agree not to modify, copy, distribute, or create derivative works based on the Service, except as expressly authorized.
User Content
You retain ownership of content you provide to the Service. However, you grant Preffect a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content in connection with operating and improving the Service.
AI and ML Disclaimers
Our Services employ AI and ML techniques to analyze your data and generate health and wellness insights, plans, and recommendations. Such outputs may not always be accurate, complete, or up-to-date. Results may vary from user to user. You agree to use these insights as informational prompts rather than definitive guidance.
Third-Party Services
The Service may provide links to or integrate with third-party services (such as Apple Health, social media platforms). Your use of third-party services may be subject to additional terms. Preffect is not responsible for third-party services or their privacy practices.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PREFFECT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
PREFFECT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA. IN NO EVENT WILL PREFFECT'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID PREFFECT IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Dispute Resolution
Arbitration Agreement
You agree that any disputes or claims between you and Preffect will be resolved through final and binding arbitration, rather than in court, except that you may assert individual claims in small claims court if your claims qualify.
No Class Actions
YOU AND PREFFECT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
Termination
Preffect may suspend or terminate your account or access to the Service for any reason, including if Preffect believes you have violated these Terms. Any termination may be effected without prior notice.
General Terms
Governing Law
These Terms will be governed by the laws of the State of California without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the Service, email, or other reasonable means. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
Entire Agreement
These Terms (together with our Privacy Policy and other referenced terms) constitute the entire agreement between you and Preffect regarding the Service.
